You agree to use the Marketplace only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Marketplace in any way that could damage, disable, overburden, or impair our servers or networks.
  • Use any automated system or software to access the Marketplace or collect information from it without our prior written consent.
  • Attempt to gain unauthorized access to any portion of the Marketplace or any other accounts, systems, or networks connected to it.

4.2. Prohibited Content

You must not upload, post, or transmit any content that:

  • Is unlawful, defamatory, obscene, or otherwise objectionable.
  • Violates any intellectual property rights or proprietary rights of any third party.
  • Contains malware, viruses, or other harmful code.

5. Digital Products 5.1. Listings

Authors are responsible for creating and managing their product listings, including descriptions, pricing, and other related information. You agree that all information provided in your product listings must be accurate and up-to-date.

5.2. Product Quality

Authors are responsible for ensuring that their digital products meet the quality standards and functionality described in their listings. Apps Masters™ is not responsible for the content, accuracy, or quality of any digital products sold through the Marketplace.

5.3. Payments and Fees

  • 5.3.1. Transaction Fees: Apps Masters™ may charge transaction fees on sales of digital products. The fee structure will be disclosed on our website or within the Marketplace interface.
  • 5.3.2. Payment Processing: Payments for digital products will be processed through third-party payment processors. By making a purchase, you agree to abide by the terms and conditions of the payment processor.

5.4. Refunds and Returns

  • 5.4.1. Refund Policy: Refunds for digital products are subject to the refund policy specified by the author. Authors are responsible for managing refund requests in accordance with their policy.
  • 5.4.2. Disputes: Any disputes regarding refunds or returns should be addressed directly with the author. Apps Masters™ will not mediate or be responsible for disputes between buyers and authors.

6. Intellectual Property 6.1. Ownership

  • 6.1.1. Apps Masters™ Content: All content, including text, graphics, logos, and software, provided on the Marketplace is the property of Apps Masters™ or its licensors and is protected by intellectual property laws.
  • 6.1.2. Author Content: Authors retain ownership of their digital products and any associated intellectual property rights. By listing a product on the Marketplace, authors grant Apps Masters™ a non-exclusive, worldwide, royalty-free license to use, display, and distribute the product as part of the Marketplace.

6.2. Infringement

If you believe that any content on the Marketplace infringes your intellectual property rights, please contact us at [support @ apps-masters.com] with detailed information about the infringement. We will investigate and take appropriate action in accordance with applicable laws.

7. Privacy

Your use of the Marketplace is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

8. Disclaimers and Limitation of Liability 8.1. Disclaimers

  • 8.1.1. No Warranty: The Marketplace is provided on an "as is" and "as available" basis. Apps Masters™ makes no warranties, express or implied, regarding the Marketplace, including its availability, accuracy, or reliability.
  • 8.1.2. Digital Products: Apps Masters™ does not endorse or guarantee the quality or functionality of any digital products listed on the Marketplace. Authors are solely responsible for their products.

8.2. Limitation of Liability

  • 8.2.1. General Limitation: To the maximum extent permitted by law, Apps Masters™ and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Marketplace.
  • 8.2.2. Maximum Liability: In no event will Apps Masters™’s total liability to you exceed the amount you paid for the digital product or service giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Apps Masters™, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or related to your use of the Marketplace, your content, or any violation of these Terms.

10. Termination

Apps Masters™ reserves the right to terminate or suspend your access to the Marketplace at any time, with or without cause, including if we believe you have violated these Terms. Upon termination, your right to access and use the Marketplace will cease immediately.

11. Modifications to Terms

Apps Masters™ reserves the right to modify these Terms at any time. Any changes will be posted on our website, and your continued use of the Marketplace after such changes constitutes your acceptance of the modified Terms.

12. Governing Law

These Terms and any disputes arising out of or related to them will be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.

13. Dispute Resolution

REFUND POLICY:

Before a refund is granted, allow us to try and help solve any problem you have by opening a ticket in our support desk. Please give it 24-72 hours for our Support Team to get back to you on your support requests. We do our best to answer a lot faster to your requests.

Nature of digital media (software) that can be downloaded instantly after a purchase has been made. There is no “trial” or “grace period” after purchasing any product which means all sales are final. Once you have purchased the software, there is no way to “return” it. As such refunds can not be provided.

We can do refund if the product you downloaded from the website was completely unusable/faulty.

Refunds will not be granted if you simply decide not to use the purchased products. We stand behind our products and will assist you in solving any problem you have, but we also expect you to adequately understand what you are purchasing and why.

Some offers might include a non-refundable clause. In this case, it will be visible or linked from the offer page.

Refund Exceptions
No refunds are provided for:

  • GPLPlus VIP Membership Subscription as it is a complete set of products at a very convenient price for which you can cancel any time. We discourage you from purchasing the VIP Membership for testing purposes.
  • Renewals are strictly non-refundable,Renewals for which you can cancel easily anytime the automatic payment at the deadline directly from your My Account page
  • requesting a refund for the same product twice.
  • Offers and discounts are valid for future orders only and can’t be used to ask for refunds or partial refunds of existing purchases.

No returns/refunds will be offered for digital products except if the product you’ve purchased is:

  • completely non-functional
  • and/or product main description was fully misleading.
  • and/or you didn’t download any or many files from our website.

– then you do have the option to request a refund.

We also reserve the right to refuse a refund in following situations:

  • you have changed your mind about an item/subscription.
  • you bought an item by mistake and the product(s) was sent/already downloaded by you.
  • product was bought by your employee or inmate from your PayPal account which he/she had legal access.
  • You can not install the downloaded product
  • The product is incompatible with your WordPress, plugins or web server settings
  • The product does not function as you want
  • The product displays a message about the need to enter a license key or activation
  • You broke your website when installing the product
  • You did not receive technical support on GPLPlus
  • you refused provide to our support staff access to your web-site to investigate our product you are having issue with.

Please also note that:

  • You may cancel your account at any time, however, there are no refunds for cancellation.
  • If you will get a refund you cannot use downloaded premium products any more.
  • If the product after update is still damaged, we may offset the amount of your refund by the diminished value of the product.
  • Refunds can take up to 14 days to reflect in your account.
